Terms of Service
Please read these Terms carefully before engaging our services. By requesting a quote, placing a booking, or using any AMA4EXPORT service, you agree to be bound by these Terms of Service.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the services provided by AMA4EXPORT ("Company", "we", "us", or "our"), including our logistics, freight forwarding, customs clearance, and export solutions.
By engaging our services — whether through our website, email, phone, or any other channel — you ("Client", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms. If you are acting on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Services
AMA4EXPORT provides international logistics and export solutions, which may include:
- Ocean Freight: Full container load (FCL) and less than container load (LCL) services.
- Air Freight: Express and economy air cargo solutions.
- Road Transport: Cross-border and last-mile trucking.
- Customs Clearance: Documentation, compliance, and duty management.
- Cargo Insurance: Optional insurance coverage for shipments.
- Shipment Tracking: Real-time status updates and reporting.
All services are subject to availability, applicable laws and regulations, and the specific terms agreed upon in the service agreement or booking confirmation for each shipment.
3. Client Obligations
You agree to:
- Provide accurate, complete, and timely information about your cargo, including weight, dimensions, contents, value, and any hazardous material classifications.
- Ensure that all goods tendered for shipment are legally exportable from the country of origin and legally importable at the destination.
- Comply with all applicable export control laws, sanctions regulations, and trade compliance requirements.
- Provide complete and accurate documentation required by customs authorities in a timely manner.
- Not tender prohibited, restricted, or undeclared goods without prior written approval.
- Pay all charges, fees, duties, and taxes as agreed and within the specified payment terms.
4. Quotes & Payments
All quotations provided by AMA4EXPORT are estimates based on the information supplied at the time of the request. Quotes are valid for 7 days unless otherwise stated and are subject to change based on carrier rate fluctuations, fuel surcharges, currency changes, or variations in cargo details.
Unless otherwise agreed in writing:
- Invoices are due within 30 days of the invoice date.
- Late payments are subject to an interest charge of 2% per month on the outstanding balance.
- AMA4EXPORT reserves the right to withhold shipment documentation until outstanding balances are cleared.
- Additional charges arising from inaccurate cargo information, port demurrage, or customs examinations are the Client's responsibility.
5. Limitation of Liability
To the maximum extent permitted by applicable law, AMA4EXPORT's total liability to you for any claim arising out of or in connection with our services shall not exceed the freight charges paid for the specific shipment giving rise to the claim.
AMA4EXPORT shall not be liable for:
- Loss or damage caused by events beyond our reasonable control, including acts of God, war, strikes, government actions, or carrier delays.
- Indirect, consequential, or special damages, including loss of profit or business opportunity.
- Delays caused by customs examination, port congestion, or regulatory holds.
- Loss or damage to cargo not declared or improperly packed by the Client.
We strongly recommend that all clients obtain adequate cargo insurance. AMA4EXPORT can arrange comprehensive coverage upon request.
6. Cargo & Customs Compliance
The Client is solely responsible for ensuring that cargo complies with all applicable import, export, and transit regulations. AMA4EXPORT acts as an agent in customs matters and relies entirely on the accuracy of information and documentation provided by the Client.
AMA4EXPORT reserves the right to refuse or discontinue the transport of any cargo that it reasonably believes to be illegal, hazardous without proper declaration, or in violation of applicable laws. Any fines, penalties, or costs arising from non-compliant shipments shall be borne entirely by the Client.
7. Confidentiality
Both parties agree to keep confidential all proprietary information shared in connection with the provision of services, including but not limited to pricing, trade routes, supplier information, and business strategies. This obligation shall survive termination of any service agreement for a period of three (3) years.
AMA4EXPORT will not sell or share your personal or business data with third parties except as required to perform the contracted services or as required by law.
8. Intellectual Property
All content on the AMA4EXPORT website, including text, graphics, logos, and software, is the property of AMA4EXPORT and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. Termination
Either party may terminate an ongoing service agreement by providing 30 days' written notice. AMA4EXPORT reserves the right to immediately suspend or terminate services without notice in the event of:
- Non-payment of outstanding invoices.
- Provision of false or misleading information.
- Breach of these Terms or any applicable law.
- Actions that expose AMA4EXPORT to legal liability or reputational harm.
Upon termination, all outstanding fees for services rendered remain payable in full.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Giza Governorate, Egypt.
For international shipments, the applicable provisions of the relevant international conventions (including Incoterms® 2020 where applicable) shall also apply.
11. Changes to These Terms
AMA4EXPORT reserves the right to update these Terms at any time. The revised Terms will be posted on this page with an updated effective date. Continued use of our services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
